Good intentions abound at this time of year, with many people resolving to ‘better’ themselves in a variety of ways (at least until the initial enthusiasm
wears off) often by trying something new or giving something up.
However there’s no reason why such resolutions can’t also be applied to captives. Below is a list of typical ‘new year’ resolutions, and a tongue-in-cheek look at how they might relate to a captive…
1. Visit exotic new locations. Investigate opportunities for captive migration, ideally domiciles which are hot and sunny, requiring frequent meetings ‘on location’.
2. Detox The annual health blitz – review and assess the captive’s performance in the context of its objectives to date. Establish new strategic and operational objectives for the year(s) ahead.
3. Lose Weight De-risk your historic liabilities, for example through commutation, novation, retrospective reinsurance or even the sale of the captive itself (see below).
4. Divorce (in light of the new streamlined you – see previous resolutions) Captive rationalisation.
5. Try new things (if you don’t fancy the above, a bit of variety can give you a new lease of life) Explore emerging and niche risks, such as pandemics, nanotechnology and digital risks.
6. Get fit Get more efficient with your capital.
7. Get a better education Improve your knowledge on Solvency II and other risk based calculations. Particularly on the impacts of the proportionality principle for captives.
8. Review finances Review investment portfolio.
9. Catch up with old friends Review all your service providers and ensure you are receiving the best service for your new and improved objectives.
10. Get a better job Optimise your insurance programme.
It would be nice to think that, with the right advice and encouragement, captives may succeed where most people fail and actually achieve some of their resolutions
before the end of the year (and not give up on them by the end of January)!

WELCOME TO THE Captive Review Cell Company Handbook 2009 – the second edition of our global directory of cell company jurisdictions. Since we last published this directory, the general attitude toward cell companies seems to have shifted up a gear. Whereas single-parent companies have long ruled the captive roost, a slight uptick in the formation of pure captives at the beginning of this year can’t hide the fact that growth in this market is still sluggish.
